Terms of Service

This is an agreement between myself, Rei as the “Artist”, and you as the “Client”. Client is hiring the artist for a commission, hereafter referred as “commission” and/ or “artwork”.By commissioning, the client agrees to Terms of Service written out on this site. Failure to comply with this Terms of Service may result in permanent blacklisting.I, the Artist, am not responsible if the Client fails to read/ confirm the Terms of Service. The Client is responsible to clarify with the Artist any policy they are unsure of.

| General Terms

• I only accept commission requests through VGen / GForm / e-mail.
• I have the right to decline any commission request if I feel I am unable to fulfil your request.
• Do not claim the artwork as your own creation.
• Do not trace, reproduce any of my artwork.
• Do not edit, modify any of my artwork without my consent.
• Do not use my artwork for any AI-related activities, such as (but not limited to) AI training and AI generated works.
• Do not use my artwork for any blockchain-related activities, such as (but not limited to) NFTs and cryptocurrency.
• Reposting commissioned artwork with watermark and proper credit is allowed.

| PAYMENT

• All prices are listed in USD (IDR price = USD price x Rp13,000).
• Listed prices on Carrd ≠ VGen (included tax fee).
• I accept payment via PayPal (invoice) / Ko-Fi and QRIS*
ㅤ*Only available for Indonesian client(s).
• Commissions must be paid 100% upfront
• Payment planning can be discussed further, only available for commissions above $200.
ㅤ⤷ Min. $100 per part : flat fee +$3.5 per part
ㅤ⤷ I, the Artist, am generally open to payment plans, but reserve the right to reject payment plans.

| Commission

• Commission slot is reserved and work time starts after payment is settled.
• I work based on the queue list/ deadline/ complexity (not first come, first serve). Queue list and waiting list are available here.
• Higher complexity will take more time to be finished.
• ADDITIONAL FEEs applied for :
ㅤㅤ› COMMERCIAL CONTENT
ㅤㅤㅤ• + 50% fee from the total commission cost.
ㅤㅤㅤ• For Client who intend to use the artwork on a medium/ platform where you receive profit from, such as (but not
ㅤ ㅤ ㅤ limited to) :
ㅤㅤㅤㅤ⤷ Music video, marketing purpose, streaming assets, game assets, etc.
ㅤㅤㅤ• Commercial content fee is not required for stream or video thumbnails.
ㅤㅤ› COMMERCIAL MERCHANDISING
ㅤㅤㅤ• + 150% fee from the total commission cost.
ㅤㅤㅤ• For Client who intend to use the artwork for mass printing, mass distribution and/ or profitable activities, such
ㅤ ㅤ ㅤ as (but not limited to) :
ㅤㅤㅤㅤ⤷ Membership/ subscription reward, printed goods, etc.
ㅤㅤ› PRIVATE COMMISSIONS
ㅤㅤㅤ• + 50% fee from the total commission cost.
ㅤㅤㅤ• Private commissions means :
ㅤㅤㅤㅤ⤷ Artwork process cannot be shown on my streams or social medias.
ㅤㅤㅤㅤ⤷ Final artwork cannot be showcased on my social medias and public portfolios at any time.
ㅤㅤㅤㅤ⤷ If the final artwork can only be shown later after completion/ after a certain date, please attach a note or
ㅤ ㅤ ㅤ ㅤyou can discuss it with me first to avoid this additional fee. Feel free to inquire!
ㅤㅤ› RUSHED COMMISSIONS
ㅤㅤㅤ• + 50% fee from the total commission cost.
ㅤㅤㅤㅤ⤷ Charges may increase pending the Client's urgency/ time requirement.
ㅤㅤㅤ• I will start your commission immediately or latest within the following week.
ㅤㅤㅤ• If you need a commission by a certain date, please tell me and we can discuss pricing.
ㅤㅤ› OTHER CHARGES
ㅤㅤㅤ• Complex designs may increase the commission cost
ㅤㅤㅤ• Any additional design work may require extra charges, such as :
ㅤㅤㅤㅤ⤷ New character/ mascot/ outfit without references, insufficient references that may require some designing
ㅤ ㅤ ㅤ ㅤto be done.

| Workflow / Process

• Send in your commission request via VGen / GForm / e-mail.
• If your request is accepted, I will contact you to discuss your commission, then I will send the invoice / quote.
• Your commission request will be added to the list of orders after I receive the payment.
• At least one sketch will be sent to you for approval.
• Revision 1 : Major changes (composition, pose, etc.) can be requested during the sketch phase.
• Lineart -> Base Color will start after the sketch is confirmed by the Client.
• Revision 2 : Minor changes (color, missing details, etc.) can be requested (up to 3 times) during lineart & base color phase unless I am at fault.
• You may NOT change the previously approved sketch/ lineart/ base color.
• Rendering will start after lineart & base color is confirmed by the Client. WIPs will be provided in the process if requested.
• Final artwork will be sent to you once it is finished and will not accept any revision in this phase unless I am at fault.
• Final delivery will be sent through a Google Drive link containing the final artwork file.
• The turnaround time may vary depending on the commission type and my schedule.

| Usage

• Regular commissions are for personal use only, unless stated otherwise.

| Refunds / cancellation

• Refund / cancellation only be requested/ done in these following circumstances :
ㅤ⤷ I, the Artist, cancel the commission and/ or unable to finish the commission.
ㅤ⤷ Work for the commission has not started within 6 months after payment.
ㅤ⤷ Partial refund for any commission started and before sketch approval.
• Other than the circumstances stated above, refund and cancellation cannot be requested by the Client.
• The Client must never request/ submit a chargeback under any circumstances. This will be considered a violation of my Terms of Service. If a refund has been agreed on, I will transfer the funds to you per our agreement.

| Usage rights

• I, the Artist, own the intellectual property rights & copyrights to the artwork and any original designs. The intellectual property rights of the existing characters drawn belong to their respective owners.
• Commissioned artwork is for personal use only unless agreed otherwise and the Client gets the license for Monetized Content and Commercial Merchandise use.
• I, the Artist, have the rights to show the commission progress and completed artwork at any time, this may be in the form of streaming on Twitch, posting on social media, showcasing for portfolio-purposes on my commission webpages.
ㅤ⤷ The above is overwritten by any agreement made with the Client for a Private Commission
• Regarding reselling the commissioned artwork: I will only consider the scenario where a Client decides to resell their persona with the commissioned artwork included as the bundle. The Client must contact me to discuss and agree on the reselling and details.
ㅤ⤷ Otherwise, the Client is prohibited to resell the personal use artwork.

| Crediting the artist

Credits to the Artist as CXDE Rei or mention @cxde_rei on all socials / @cxde_00 on TikTok or a link : https://cxde-rei.carrd.co must be explicitly given anytime the art is showcased.

| Disclaimer

• You will be receiving a digital file of the final artwork (no physical product)
• Pricing is subject to change, any changes will be announced, and the Client will be charged according to the price listed at the moment of confirmation of your commission request.
• I will only draw in my own art style and will not imitate other artist’s styles or change the way I draw.
